State Tax Rate Requirements
Under Texas law, if a school district’s governing body adopts a tax rate that exceeds the district’s voter-approval tax rate, registered voters of the district must determine at an election whether to approve the adopted rate. If a simple majority of votes cast favor the adopted rate, the rate stands; if voters disapprove it, the governing body may not adopt a tax rate exceeding the voter-approval rate. TASBOtexas
Truth-in-taxation rules require most taxing units, including school districts, to calculate a no-new-revenue tax rate and a voter-approval tax rate after receiving a certified appraisal roll from the chief appraiser. The no-new-revenue rate is generally calculated as the prior year’s taxes divided by the current taxable value of properties on the tax roll in both years, used for comparison purposes.
